Terms of Service

1. Acceptance of Terms

By accessing or using resums.online ("the Service"), operated by Resums Online ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Resums Online is a recruitment platform that uses artificial intelligence to analyze resumes against job-specific competencies. The Service includes:

  • Upload and OCR extraction of resumes (PDF, DOCX, images).
  • AI-powered evaluation and ranking of candidates.
  • Email integration for candidate communication.
  • Interview scheduling with calendar integration.
  • Public career portals and intake forms.
  • Team collaboration features.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your account.
  • You must be at least 18 years old to use the Service.
  • One person or entity may not maintain more than one free trial account.

4. Free Trial

  • New users receive a 15-day free trial with 50 credits and a limit of 10 resumes.
  • No credit card is required for the trial.
  • After the trial period, you must subscribe to a paid plan to continue using the Service.
  • We reserve the right to modify or discontinue the free trial at any time.

5. Subscriptions and Payments

  • Paid plans are billed monthly via Stripe.
  • Each plan includes a monthly credit allowance. One credit equals one resume processed.
  • Monthly credits reset at the beginning of each billing cycle and do not roll over.
  • Extra credits may be purchased separately and do not expire.
  • Prices are in EUR and include applicable taxes.
  • You may upgrade, downgrade, or cancel your subscription at any time from your account settings.
  • Downgrades take effect at the end of the current billing cycle.
  • Refunds are not provided for partial months of service or unused credits.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload content that infringes on third-party intellectual property rights.
  • Upload malicious files, viruses, or harmful code.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Use the Service to discriminate against candidates on the basis of race, gender, age, disability, religion, sexual orientation, or any other protected characteristic.
  • Resell, sublicense, or redistribute the Service without our written consent.
  • Use automated tools to scrape or extract data from the Service.
  • Interfere with or disrupt the integrity or performance of the Service.

7. Data and Content Ownership

  • Your data: You retain all rights to the resumes, candidate data, and other content you upload. We do not claim ownership of your content.
  • License to us: By uploading content, you grant us a limited license to process, store, and analyze it solely to provide the Service.
  • Our service: The Service, including its software, design, and AI models, is owned by us and protected by intellectual property laws.
  • Data portability: You may export your data at any time using the available export features (CSV export).

8. AI-Generated Analysis

  • AI-generated scores and rankings are provided as decision-support tools only.
  • The Service does not make hiring decisions. You are solely responsible for all recruitment decisions.
  • AI analysis is probabilistic and may contain errors. You should review results before acting on them.
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated outputs.

9. Candidate Data Responsibility

  • You are the data controller for candidate personal data you upload to the Service.
  • You are responsible for ensuring you have a lawful basis to process candidate data (e.g., legitimate interest in recruitment).
  • You must comply with GDPR and applicable data protection laws regarding candidate data.
  • We act as a data processor on your behalf. Our processing is governed by our Privacy Policy.

10. Service Availability

  • We aim to maintain high availability but do not guarantee uninterrupted service.
  • We may perform maintenance that temporarily affects availability, with reasonable notice when possible.
  • We are not liable for interruptions caused by factors beyond our reasonable control.

11. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind.
  • We are not liable for any indirect, incidental, special, or consequential damages.
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
  • We are not liable for hiring decisions made using the Service.

12. Termination

  • You may close your account at any time from your account settings.
  • We may suspend or terminate your account for violation of these Terms, with notice when reasonably possible.
  • Upon termination, your data will be retained for 30 days to allow recovery, then permanently deleted.
  • Sections 7, 8, 11, and 14 survive termination.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or in-app notice at least 15 days before taking effect. Continued use after changes constitutes acceptance. If you disagree with the new terms, you may close your account before they take effect.

14. Governing Law

These Terms are governed by the laws of Portugal. Any disputes shall be submitted to the courts of Lisbon, Portugal, without prejudice to mandatory consumer protection provisions that may apply in your jurisdiction.
